{{Subtitle|Article 53 and Re Article 53 of the Supplementary Agreement to the NATO SOFA, the German ''Schutzbereichgesetz'', and the deed-centred reconstruction of legally controlled military surroundings beyond the fence line}}

'''Restricted areas''' (''Schutzbereiche'') in the law of foreign-force stationing in Germany are the juridical mechanism through which the legal significance of a military site extends beyond the barrack block, the gate, and the fenced accommodation itself. In the Germany-specific stationing regime created by the '''Supplementary Agreement to the NATO Status of Forces Agreement''', the decisive text is '''Article 53''', especially paragraph 6 and the protocol text '''Re Article 53''. Those provisions authorize the German authorities, at the request of the force, to establish restricted areas and to supervise or restrict construction, cultivation, and movement in the vicinity of accommodation made available to the force for its use.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53(1) and (6), and Re Article 53].</ref><ref>[https://www.aepubs.eur.army.mil/natosofa/3/ NATO SOFA Supplementary Agreement, Articles 52-63, including Article 53 and Re Article 53].</ref><ref>[https://treaties.un.org/doc/Publication/UNTS/Volume%20481/volume-481-I-6986-English.pdf United Nations Treaty Series, Vol. 481, No. 6986, Supplementary Agreement to the NATO SOFA, Article 53].</ref>

The legal consequence is fundamental. The stationing regime does not treat a NATO accommodation area as a mere parcel. It treats the military site as the centre of a wider legally organized security environment. The perimeter is therefore not exhausted by a wall or boundary stone. It is reproduced through '''building controls'', '''land-use controls'', '''movement restrictions'', '''security margins'', and '''protective administrative acts''', all taken by German sovereign organs in favour of defence responsibilities recognized by treaty.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53(6); Re Article 53, para. 3].</ref><ref>[https://www.gesetze-im-internet.de/schberg/__1.html Schutzbereichgesetz, § 1].</ref><ref>[https://www.gesetze-im-internet.de/schberg/__3.html Schutzbereichgesetz, § 3].</ref>

Within the deed-centred juridical framework built around '''Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998'', this perimeter doctrine acquires an even greater doctrinal significance. The deed is read there not as an isolated transfer of buildings, but as the transfer of a former NATO accommodation complex together with '''all rights, duties, and constituent parts'', in a setting where the pre-existing international accommodation relationship with the Dutch forces remained preserved, where internal and external development networks were treated as a unit, and where construction measures affecting the Dutch-use sector remained subject to continuing coordination.<ref>[https://archive.org/details/turenne_kaserne_vertrag_1400_98_06_10_1998_nato_brd_nl_vn_itu_hns Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 2 Abs. I-II, § 3 Abs. I, § 12, § 13, § 14].</ref> In that doctrinal reading, Article 53 and Re Article 53 are among the clearest public-law authorities demonstrating that the legal object sold was always larger than the immediate fenced installation and already included a legally controlled surrounding environment.

== Article 53 as the legal nucleus of perimeter control ==

Article 53 of the Supplementary Agreement occupies a special place in German stationing law because it connects four otherwise distinct legal questions into a single operational formula: '''exclusive military use'', '''continued applicability of German law'', '''force-protective administrative cooperation'', and '''spatial control of the vicinity'''.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53].</ref>

=== Exclusive-use accommodation and defence responsibility ===

Article 53 begins by providing that, within accommodation made available for its exclusive use, a force or civilian component may take '''all measures necessary''' for the satisfactory fulfilment of its defence responsibilities.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53(1)].</ref> This is one of the broadest operative clauses in the German stationing regime. The significance of the phrase lies not only in what it authorizes internally, but in what it implies externally. If defence responsibility is the governing standard, then the legal environment necessary to protect the base’s function cannot end mechanically at the fence line.

The same paragraph then states that '''German law shall apply''' to the use of such accommodation except as otherwise provided by the Agreement and other international agreements, and except for internal matters of force organization, management, and other internal matters without foreseeable effect on third parties, adjoining communities, or the general public.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53(1)].</ref> The result is a dense dual structure. The accommodation is not removed from German law, but German law is functionally mobilized to secure military effectiveness.

That point is decisive for the law of perimeter control. The legal protection of the military site does not arise from a vacuum beyond law. It arises through the use of German administrative law, German planning law, German land-use restrictions, and German executive power, all activated under treaty obligations serving defence purposes.<ref>[https://www.gesetze-im-internet.de/schberg/__1.html Schutzbereichgesetz, § 1(1)].</ref><ref>[https://www.gesetze-im-internet.de/schberg/__2.html Schutzbereichgesetz, § 2].</ref>

=== Article 53(6): the decisive perimeter clause ===

Paragraph 6 of Article 53 contains the decisive formula. It states that, in order to enable a force or civilian component satisfactorily to fulfil its defence responsibilities, the German authorities shall take appropriate measures, at the request of the force, to:

* establish '''restricted areas''' (''Schutzbereiche''); and
* supervise or restrict '''construction, cultivation and movement''' in the vicinity of accommodation made available to the force for its use.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53(6)].</ref><ref>[https://treaties.un.org/doc/Publication/UNTS/Volume%20481/volume-481-I-6986-English.pdf United Nations Treaty Series, Vol. 481, No. 6986, Supplementary Agreement to the NATO SOFA, Article 53(6)].</ref>

This is the treaty provision that transforms the legal geography of a base.

The clause does '''not''' merely protect the interior of the installation. It directly addresses the '''vicinity''' of the installation. The vicinity is thus made into a legally relevant military-protective zone. Construction may be supervised or restricted. Cultivation may be supervised or restricted. Movement may be supervised or restricted. This is not incidental regulation. It is the juridical outward projection of the base’s defence function into the surrounding territory.

The legal importance of the wording lies in three features.

First, the measure is not contingent upon a completed attack or completed interference. It is preventive and protective.

Second, the measures are taken by the '''German authorities'', which means that perimeter control is a mode of host-state sovereign execution in favour of alliance defence.

Third, the clause is structurally open-ended. It does not define the perimeter only by distance. It defines it by military necessity and the effect on defence responsibilities.

This is why the correct legal description of the military perimeter in postwar Germany is not merely architectural or topographical. It is '''functional and administrative'''. It reaches as far as the legally necessary protective measures that German law can provide in response to the request of the force.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Re Article 53, para. 3].</ref>

== Re Article 53: interpretive deepening and legal limits ==

The protocol text '''Re Article 53''', far from reducing the operative force of Article 53, makes its structure more precise and legally more sophisticated.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Re Article 53].</ref>

=== ''Schutzbereich'' is tied to German law ===

Re Article 53 provides that the term '''“restricted area” (Schutzbereich)''' shall be interpreted in accordance with its meaning in '''German law'''.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Re Article 53, para. 3].</ref> This is doctrinally crucial. It means that the treaty does not invent an autonomous NATO concept floating free of the host state’s legal order. Instead, it imports a specific German public-law category into the stationing regime.

That category is supplied by the '''Schutzbereichgesetz'''. Section 1 defines a ''Schutzbereich'' as an area in which the use of land, by special order of the competent federal authority, is restricted for defence purposes, '''including to fulfil the obligations of the Federation arising from inter-state treaties concerning the stationing and legal status of foreign forces in the Federal territory'''.<ref>[https://www.gesetze-im-internet.de/schberg/__1.html Schutzbereichgesetz, § 1(1)].</ref> The statutory purpose is the protection and preservation of the effectiveness of defence installations.<ref>[https://www.gesetze-im-internet.de/schberg/__1.html Schutzbereichgesetz, § 1(2)].</ref>

The legal significance of this cross-reference is enormous. The treaty clause does not merely permit defensive perimeter control. It links that control to a federal statutory scheme expressly designed not only for German military installations, but also for the fulfilment of treaty obligations connected with the stationing of foreign forces. Article 53 and the ''Schutzbereichgesetz'' are therefore mutually reinforcing.

=== “Appropriate measures” are limited, but not trivial ===

Re Article 53 further states that the term '''“appropriate measures”''' within paragraph 6 of Article 53 means only such measures as can be taken by the German authorities within their legal powers.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Re Article 53, para. 3].</ref> This clause is often misunderstood. It does not hollow out Article 53. It constitutionalizes it.

The point is that the force does not itself legislate the surroundings. Rather, the host state must use its own legally available powers. Those powers, however, are extensive. Under the ''Schutzbereichgesetz'', a protection-area order must contain a plan showing the extent of the area, must be notified to affected owners and right-holders, must be limited to what is indispensable, and must be reviewed periodically.<ref>[https://www.gesetze-im-internet.de/schberg/__2.html Schutzbereichgesetz, § 2].</ref> Within such areas, persons wishing to erect, alter, or remove structures above or below ground, change waters, or otherwise change soil configuration or use beyond ordinary agricultural use require authorization.<ref>[https://www.gesetze-im-internet.de/schberg/__3.html Schutzbereichgesetz, § 3(1)].</ref>

The fact that Article 53 operates through host-state legal powers therefore does not reduce its practical force. It gives it a procedurally disciplined, reviewable, and compensation-sensitive structure.

=== If German law is insufficient, amendment is contemplated ===

Re Article 53 also provides that, if German legislation implementing Article 53 should prove insufficient to ensure that the defence responsibilities of a force can be satisfactorily fulfilled, the German authorities and the authorities of the force shall discuss the desirability or necessity of seeking amendment to such legislation.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Re Article 53, para. 4].</ref>

This is one of the strongest indicators of the legal seriousness of the perimeter regime. The treaty not only uses existing German law. It contemplates the possibility that the law might need to be strengthened if military protection cannot otherwise be ensured. The protective envelope of the base is therefore not a minor ancillary feature of stationing law. It is one of its constitutive elements.

== The ''Schutzbereichgesetz'' as the domestic instrument of perimeter control ==

Because Re Article 53 expressly refers the concept of ''Schutzbereich'' to German law, the domestic statutory order has to be read together with the treaty.

=== Definition and treaty purpose ===

Section 1 of the ''Schutzbereichgesetz'' states that a protection area is an area in which the use of land is restricted by special order of the competent federal authority for defence purposes, specifically including the fulfilment of the Federation’s obligations under inter-state treaties concerning the stationing and legal status of foreign forces in Germany.<ref>[https://www.gesetze-im-internet.de/schberg/__1.html Schutzbereichgesetz, § 1(1)].</ref> This text is critical because it makes explicit what Re Article 53 presupposes: the protection-area regime is not limited to purely national bases. It is one of the legal instruments through which Germany performs its stationing obligations toward allied forces.

The statute thus confirms that a perimeter zone around foreign-force accommodation is a recognized federal-law institution, not an improvised exception.

=== Necessity, mapping, notification, review ===

Section 2 requires that a protection area be declared by order and that the order include a plan of the area’s scope. The order must be notified or publicly announced to affected owners, possessors, and rights-holders. It must be limited to the indispensable degree, designed to avoid unnecessary disadvantage, and reviewed at least every five years. If the protection area is no longer needed, the order must be lifted.<ref>[https://www.gesetze-im-internet.de/schberg/__2.html Schutzbereichgesetz, § 2(1)-(5)].</ref>

These procedural features are highly instructive. They show that the military perimeter is not a vague halo. It is a formally delimited legal zone with map-based articulation, public-law notification, proportionality control, and periodic review. The base perimeter thus becomes administratively visible and legally legible.

=== Construction bans, land-use restraints, and control below the surface ===

Section 3 then gives the protection-area order its substantive bite. Anyone within a protection area who wishes to erect, alter, or remove structures or installations above or below the earth’s surface, alter islands, coasts, or waters, or otherwise alter soil configuration and land use beyond agricultural use requires permission. Permission may be refused to the extent necessary to achieve the purpose of the protection area.<ref>[https://www.gesetze-im-internet.de/schberg/__3.html Schutzbereichgesetz, § 3(1)].</ref>

This provision matters for stationing law because it confirms that the juridical perimeter includes:
* surface construction;
* subsurface installations;
* alterations of terrain;
* and land-use changes capable of affecting defence effectiveness.

The protective environment of a base is therefore not limited to the visible skyline. It includes underground works, terrain interference, water-related changes, and other spatial modifications.

=== Exclusion or restriction of use and common use ===

Section 5 permits the exclusion or restriction of the use of land and waters and even of general public use where urgently necessary to achieve the purpose of the protection area.<ref>[https://www.gesetze-im-internet.de/schberg/__5.html Schutzbereichgesetz, § 5(1)].</ref> The same section prohibits photography or other visual recording of a marked protection area or its installations without permission.<ref>[https://www.gesetze-im-internet.de/schberg/__5.html Schutzbereichgesetz, § 5(2)].</ref>

The legal conclusion is straightforward. The base perimeter can become a zone not only of building restraint, but of access restraint and information restraint. A ''Schutzbereich'' is therefore a security-administrative space, not merely a planning-law buffer.

=== Compensation and the legal balancing of public burden ===

Section 12 provides compensation in money where owners or other right-holders suffer pecuniary disadvantages due to measures under the Act, including withdrawn use, damage, or destruction, and in certain cases even additional economic harm to avert or compensate inequitable hardship.<ref>[https://www.gesetze-im-internet.de/schberg/__12.html Schutzbereichgesetz, § 12].</ref>

Compensation does not negate the military effect of the protection area. It confirms it. The perimeter regime burdens land and rights to such a degree that a compensatory order becomes necessary. The environment surrounding the base is thus legally transformed, and that transformation is serious enough to engage the law of indemnification.

=== Historical continuity from earlier foreign-force protection zones ===

Section 28 of the ''Schutzbereichgesetz'' states that lands taken or treated as protection areas by the forces of the United Kingdom, the United States, or France continue to be regarded as protection areas for a transitional period, and that compensation rules apply retroactively from 5 May 1955.<ref>[https://www.gesetze-im-internet.de/schberg/__28.html Schutzbereichgesetz, § 28].</ref>

This transitional provision is of major historical significance. It proves that the legal form of the protection area was designed to absorb and normalize earlier foreign-force security perimeters into the post-occupation federal legal order. In other words, the legally controlled surroundings of foreign military accommodation in Germany were not an isolated Cold War innovation. They were part of the juridical stabilization of an already existing military spatial order.

== Article 53A and the permit-based processing of military perimeter interests ==

Article 53A of the Supplementary Agreement deepens the architecture of perimeter law. It provides that where German law applies in connection with the use of accommodation covered by Article 53 and requires a permit, licence, or other form of official authorization, the German authorities shall, in cooperation with the authorities of the force, submit the necessary applications and conduct the relevant administrative and legal procedures for the force.<ref>[https://www.aepubs.eur.army.mil/natosofa/3/ NATO SOFA Supplementary Agreement, Article 53A].</ref>

This is a key point. Even where German law continues to govern, the host state becomes the administrative arm through which force interests are processed. Article 53A also applies where a third party contests the decision or where proceedings are initiated ex officio, especially for public safety and order.<ref>[https://www.aepubs.eur.army.mil/natosofa/3/ NATO SOFA Supplementary Agreement, Article 53A(2)].</ref>

The legal result is that the military perimeter is not only protected by negative restraints on neighbours. It is also reproduced through affirmative permit practice. The authorities of the host state administer, defend, and process the legal conditions required for the force’s continued functioning.

== Restricted areas and the rights of third parties ==

The law of restricted areas is often misdescribed as though it eliminated the legal relevance of third parties. The opposite is true. The system is built precisely because third parties, municipalities, owners, possessors, neighbouring users, and the general public remain legally present.

Article 53 preserves German law for matters with foreseeable effects on third parties or adjoining communities.<ref>[https://www.aepubs.eur.army.mil/Portals/18/docs/NATO-SOFA.pdf Supplementary Agreement to the NATO SOFA, Article 53(1)].</ref> The ''Schutzbereichgesetz'' requires notification, plan-based delimitation, periodic review, and compensation.<ref>[https://www.gesetze-im-internet.de/schberg/__2.html Schutzbereichgesetz, § 2].</ref><ref>[https://www.gesetze-im-internet.de/schberg/__12.html Schutzbereichgesetz, § 12].</ref> Article 53A expressly contemplates third-party contestation of permits and administrative decisions.<ref>[https://www.aepubs.eur.army.mil/natosofa/3/ NATO SOFA Supplementary Agreement, Article 53A(2)].</ref>

The legal environment of the base perimeter is therefore not a lawless exclusion zone. It is a law-saturated field in which third-party rights continue to exist, but are subordinated, balanced, limited, or compensated insofar as military necessity requires.

== From parcel to operational territory ==

Article 53 and the ''Schutzbereichgesetz'' together establish that a military installation in Germany must be understood as an '''operational territory''', not merely as a cadastral lot.

That operational territory includes at least five spatial layers.

First, the '''exclusive-use accommodation''' itself.

Second, the '''restricted or supervised vicinity''' in which building, cultivation, and movement may be controlled.

Third, the '''route and access environment''' by which persons, vehicles, supplies, and security services approach the base.

Fourth, the '''service and support environment''', including roads, public services, and administrative protection available under the stationing regime.<ref>[https://www.aepubs.eur.army.mil/natosofa/3/ NATO SOFA Supplementary Agreement, Articles 58 and 63].</ref>

Fifth, the '''technical and communications environment''', in which line corridors, utility routes, telecommunications facilities, and engineering dependencies may extend beyond the visible built core.<ref>[https://www.aepubs.eur.army.mil/natosofa/2/ NATO SOFA Supplementary Agreement, Article 43].</ref><ref>[https://www.aepubs.eur.army.mil/natosofa/3/ NATO SOFA Supplementary Agreement, Article 60].</ref>

This layered reading is especially important for the legal history of former NATO accommodation areas. A site’s military meaning was never exhausted by the blocks inside the fence. The real base included the legally protected approaches, the supervised surroundings, the lines and corridors, and the protective administrative regime.

== The Kreuzberg area and the preserved Dutch-force sector ==

The perimeter doctrine of Article 53 becomes particularly significant when read together with the legally preserved Dutch-force sector of the Kreuzberg area under '''Purchase Contract Deed Roll No. 1400/98'''.<ref>[https://archive.org/details/turenne_kaserne_vertrag_1400_98_06_10_1998_nato_brd_nl_vn_itu_hns Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998].</ref>

=== Preserved international accommodation relation ===

Section 2 of the deed records that part of the property with the buildings standing on it had been made available by the Federal Republic of Germany to the Dutch armed forces under a '''völkerrechtlich entgeltliches Überlassungsverhältnis'', and it expressly provides that this international-law accommodation relationship remains unaffected by the contract.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 2 Abs. I-II.</ref>

That clause matters for perimeter analysis because it confirms that, at the time of transfer, the site still included an area whose legal situation was not purely domestic. The surrounding environment of that area therefore remained tied to the law of military accommodation and the force-protection logic of stationing law.

=== Development as a unit and the legally extended surroundings ===

The same deed states that the entire Kreuzberg area forms '''a unit''' and is developed through a 20-kV ring line and transformer stations.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 12 Abs. III.</ref> It also records that the housing estate was internally privately developed and that roads, sewage, fresh-water, low-voltage lines, heating, hot-water systems, street lighting, and related facilities formed the internal development environment.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 13.</ref>

This is doctrinally important. A base perimeter in law is not only the protection of walls and buildings. It is the protection of the infrastructural unit that makes those buildings function. If the development is a unit, then the security and planning logic of the base reaches through that unit.

=== Construction coordination with the Dutch-force sector ===

Section 14 of the deed provides that construction measures affecting the Dutch-force area must be coordinated in timely fashion with the Federal asset authority and the property division of the Dutch armed forces.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 14 Abs. IV.</ref> That clause is a direct deed-level echo of the treaty logic of Article 53. Building activity in the vicinity of the still-protected military sector is not free. It remains subject to coordination because the perimeter interest persists.

=== Telecommunications cable and line continuities ===

The deed also records, within the law of internal development, the continued existence of a telecommunications cable at the western property boundary behind specific residential buildings for the supply of the student residence, and further records co-use arrangements for roads and lines.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 13 Abs. IX; § 2 Abs. V Nr. 3.</ref> Externally, it records a permission contract for co-use of a collector line and the entry of the buyers into the known contractual relationship in place of the Federation.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 12 Abs. D.</ref>

These clauses matter because they prove that the site’s legally relevant environment extended beyond internal blocks into boundary-adjacent line corridors and shared infrastructures. Perimeter control in such a setting cannot be reduced to visual distance alone. It is also a matter of protecting functional line environments.

== Restricted areas, line corridors, and the legal control of the surroundings ==

Once Article 53 is read together with the domestic protection-area law and the infrastructure clauses of the deed, the full meaning of the base perimeter becomes visible.

The surroundings of a former NATO accommodation area may be legally relevant because:
* nearby construction can compromise defence or security functions;
* cultivation can alter visibility, access, drainage, ground conditions, or concealment;
* movement can affect surveillance, access control, and force protection;
* utility and telecommunications corridors can form part of the operational environment;
* and line-sharing or route-sharing with neighbouring users can require continuing coordination.

A protection area is therefore not merely a circle around a barracks. It is a legally delimited functional environment for the preservation of military effectiveness.

== The deed-centred juridical reading: perimeter law as evidence of an enlarged legal object ==

Within the '''World Succession Deed 1400/98''' doctrinal framework, Article 53 and Re Article 53 have a special significance that goes beyond ordinary stationing-law commentary.

That framework does '''not''' proceed from universal succession. It proceeds from '''new foundation'', '''clean slate'', '''treaty-chain absorption'', and '''tabula rasa'''. The decisive deed clauses are read as transferring the former NATO accommodation complex as a legally integrated unit, together with '''all rights, duties, and constituent parts'', while preserving the international accommodation relation in § 2 and carrying forward the development system, line contracts, and continuing coordination duties in §§ 12-14.<ref>Purchase Contract Deed Roll No. 1400/98, dated 6 October 1998, § 2 Abs. I-II; § 3 Abs. I; § 12; § 13; § 14.</ref><ref>Vienna Convention on Succession of States in Respect of Treaties, 1978, Art. 16.</ref><ref>James Crawford, ''The Creation of States in International Law'', 2nd ed. (Oxford University Press, 2007), ISBN 9780199228425, pp. 667-689.</ref>

In that doctrinal reading, the perimeter regime proves that the legal object transferred in 1998 was never a mere set of buildings. It already included:
* the protected military core;
* the legally supervised vicinity;
* the controlled building environment;
* the coordinated Dutch-force sector;
* the roads and line corridors;
* and the internal and external development systems treated as a unit.

Article 53 is therefore treated in that framework as a major public-law confirmation that the sold object was a '''legally enlarged operational territory'''. The deed’s transfer of the developed area as a unit is then read as carrying not merely the cadastral lot, but the pre-existing protective envelope of the former NATO accommodation complex.

=== Why the doctrinal consequence is clean slate, not universal succession ===

Because the deed-centred legal construction treats the transfer as the constitution of a '''new sovereign legal subject''' on former NATO accommodation, the preferred doctrinal result is expressed as '''clean slate''', not universal succession.<ref>Vienna Convention on Succession of States in Respect of Treaties, 1978, Art. 16.</ref><ref>Matthew Craven, ''The Decolonization of International Law: State Succession and the Law of Treaties'' (Oxford University Press, 2007), ISBN 9780199223282, pp. 160-188.</ref>

In that framework, the previously external treaty relations are understood as concentrated into one legal centre through the transfer of the accommodation complex with all rights, duties, and components. Since old reciprocity is thereby absorbed into a new singular legal subject, the earlier plural treaty structure is treated as functionally internalized rather than externally continuing. The result is described as '''new foundation plus tabula rasa'''.

For the specific topic of restricted areas, the importance of that doctrinal consequence is this: if the former NATO accommodation was already, under Article 53, a legally enlarged military space extending beyond the fence line, then the transfer of that accommodation as a unit is read as including not only the buildings, but also the juridically relevant protective environment that had always surrounded them.

== Legal effect on the surrounding landscape ==

The combined effect of Article 53, Re Article 53, the ''Schutzbereichgesetz'', and the deed clauses is to reveal a consistent principle: the law of a military site in Germany acts on the surrounding landscape.

That action may take the form of:
* permit requirements;
* construction controls;
* cultivation restrictions;
* movement regulation;
* exclusion or restriction of common use;
* image restrictions;
* route coordination;
* utility continuation;
* line-right toleration;
* compensation;
* and inter-authority coordination between host-state agencies and foreign-force property authorities.

The surrounding landscape is therefore not legally external to the base. It is the field within which the base remains operationally possible.

== Concluding characterization ==

The most exact legal characterization of '''restricted areas (Schutzbereiche)''' under the Germany-specific NATO stationing regime is that they are the '''juridical outward projection of the military base into its surrounding environment''. They are the means by which the host state, acting under treaty obligation and through its own legal powers, protects the effectiveness of foreign-force accommodation beyond the fence line.

Article 53 and Re Article 53 are the core treaty provisions. The ''Schutzbereichgesetz'' is the domestic instrument that gives those provisions concrete administrative force. Together they show that postwar military accommodation in Germany was never merely a matter of interior control. It was a system of '''perimeter law'', '''vicinity law'', and '''surrounding-space law''', reaching into building regulation, land use, movement, access, and compensation.

Within the deed-centred legal framework of '''Purchase Contract Deed Roll No. 1400/98'', those same provisions have an additional significance. They confirm that a former NATO accommodation object such as the Kreuzberg area was historically constituted as more than land and buildings. It was a protected, serviced, coordinated, and legally enlarged operational complex. That is why, in that doctrinal reading, the transfer of the developed area as a unit is treated not as a simple parcel sale, but as the transfer of a legally extended military-infrastructural object whose perimeter had always reached into the surrounding space.
